Section 47 of the Disability Discrimination Act 1995 (DDA) provides for an exemption procedure to allow for rail vehicles which do not comply with the Rail Vehicle Accessibility Regulations 1998 (RVAR) to be operated in service. The Rail Vehicle (Exemption Applications) Regulations 1998 set out how operators should apply for an exemption and the information they will need to supply in support of their application. The DDA requires the Secretary of State for Transport to consult on any applications for an exemption with the Disabled Persons Transport Advisory Committee (DPTAC, the Government's statutory advisers on the transport needs of disabled people). The Department also consults other appropriate bodies such as HM Railway Inspectorate, the Strategic Rail Authority and the Office of Rail Regulation. Their recommendations are taken into account before a final decision on whether to grant the application is taken.
