Statutory Instrument 2007 No. 1951 - The Street Works (Registers, Notices, Directions and Designations) (England) Regulations 2007
The Statutory Instrument, sets out the requirements for the keeping of registers and giving notices of works, and also the procedure for designating streets as subject to special controls. they were laid 11 July 2007 and come into force 1 April 2008.

Statutory Instrument 2007 No. 1952 - The Street Works (Fixed Penalty) (England) Regulations 2007
The Statutory Instrument sets out the Fixed Penalty Notices regime for certain offences under the New Roads and Street Works Act 1991, as amended by the Traffic Management Act 2004. They were laid 11 July 2007 and come into force 12 May 2008.

The Street Works (Qualifications of Supervisors and Operatives) Regulations 1992. These set out the qualifications required for supervisors and trained operatives carrying out street works.

The Street Works (Maintenance) Regulations 1992. These set out the circumstances under which a street authority can carry out works to inspect apparatus belonging to an undertaker, where they consider that that apparatus has not been properly maintained. They also allow an authority to carry out emergency works in such circumstances.

The Street Works (Inspection Fees) Regulations 1992, The Street Works (Inspection Fees) (Amendment) Regulations 1998 and The Street Works (Inspection Fees) (Amendment) (England) Regulations 2001 set out the fee levels and arrangements under which undertaken pay street authorities to inspect their work. All 3 have now been revoked, as regards England, and the new arrangements are set out in The Street Works (Inspection Fees) (England) Regulations 2002 and the Street Works (Inspection Fees) (England) (Amendment) Regulations 2004.

Letter to interested parties raising the sample inspection fee level from £20.00 to £21.00. The Street Works (Inspections Fees) (England) (Amendment) Regulations 2004 (SI No 572) came into force on 1 April 2004. These Regulations raise the sample inspection fee level from £20.00 to £21.00. These regulations apply in England only.

The Street Works Register (Registration Fees) Regulations 1999. These provide for undertakers to pay fees to highway authorities for the registration of certain information on a street works register.

The Street Works (Reinstatement) Regulations 1992 and The Street Works (Reinstatement) (Amendment) Regulations 1992. The first of these sets out the standards of workmanship and performance required from, and the materials to be used by, undertakers when they reinstate the highway after street works. The second set of Regulations corrects a minor error in the first. These have now been amended by The Street Works (Reinstatement) (Amendment) (England) Regulations 2002

The Street Works (Registers, Notices, Directions and Designations) Regulations 1992. These set out the requirements for keeping street works registers and giving notices of works, and also the procedure for designating streets as subject to special controls (i.e. as "protected", "traffic-sensitive" or having "special engineering difficulties"). They also provide the legal definitions of certain types of works.

The Street Works (Registers, Notices, Directions and Designations) (Amendment) Regulations 1995. These add a further requirement on the keeping of street works registers.

The Street Works (Registers, Notices, Directions and Designations) (Amendment No. 2) Regulations 1995, which contained errors, were revoked later in that year by the Street Works (Registers, Notices, Directions and Designations) (Amendment No. 3) Regulations 1995. These latter Regulations amend the arrangements for designating streets as "traffic-sensitive".

The Street Works (Registers, Notices, Directions and Designations) (Amendment) Regulations 1999. These provide for highway authorities designating streets as subject to special controls, or withdrawing such designations, to inform the concessionaire responsible for the National Street Gazetteer.

The Street Works (Sharing of Costs of Works) Regulations 1992 and the Street Works (Sharing of Costs of Works) (England) Regulations 2001. The 1992 Regulations set out the arrangements for sharing the costs of certain works which result from major highway, bridge and transport works. The 2001 Regulations revoke and replace the earlier ones, and introduce new, lower, undertaker contributions in respect of certain kinds of major transport works.

The Street Works (Charges for Unreasonably Prolonged Occupation of the Highway) (England) Regulations 2001. These provide powers for highway authorities to charge undertakers a daily fee where they fail to complete works by an agreed deadline. Also available: Regulatory Impact Assessment

The Street Works (Charges for Occupation of the Highway) (England) Regulations 2001 These regulations allow highway authorities to apply to the Government to operate "lane rental" schemes under which they would charge undertakers a daily rate when the latter carry out works on or under highways. These regulations are to be used solely for the purpose of running pilot schemes in certain local authority areas. Were a decision to be taken in the future to make the charging powers available to local authorities across England then further regulations would need to be prepared. The Street Works (Recovery of Costs) (England) Regulations 2002 These come into force on 1 September 2002 and sets out the arrangements under which undertaken can claim costs from highway authorities for carrying out work, and vice versa. Also available: Regulatory Impact Assessment

The Street Works (Records) (England) Regulations 2002 come into force on 1 May 2003 and set out the form and manner of keeping records of apparatus in England. Also available: Regulatory Impact Assessment

NOTE: As indicated in the appropriate places, some of the sets of Regulations listed above relating to street works have been either revoked or modified by later Regulations. They are however retained on this web site for reference purposes.
