Directions and Guidance Section 206(3) and Section 207(5) Transport Act 2000
The Secretary of State for Transport, in exercise of his powers under sections 207(5) and 209(5) of the Transport Act 2000 1(a), hereby gives the following directions to the Strategic Rail Authority, which vary the effect of the Principal Directions and Guidance, as follows:
Interpretation
- In this document -
"the Principal Directions and Guidance" means the Directions and Guidance issued to the Strategic Rail Authority by the Secretary of State for Transport, Local Government and the Regions on 11 April 2002, including subsequent amendments; and
"Greater Anglia franchise agreement" means the franchise agreement to be entered into prior to 1 April 2004 between the SRA and the successful bidder for the franchise in respect of railway passenger services in the Greater Anglia region.
Direction
- In accordance with Paragraph 5 to Annex B to the Principal Directions and Guidance, the Secretary of State directs the Strategic Rail Authority to disregard the direction to "secure that minimum levels of service remain at least equivalent to those specified in the current passenger service requirements or which are otherwise contractual obligations" in relation to the Greater Anglia franchise agreement.
- The Secretary of State directs the Strategic Rail Authority to secure in the Greater Anglia franchise agreement an appropriate level of rail services, in accordance with its statutory duties and having regard to expected levels of passenger demand and the need to secure progressive improvements in service performance.
- The directions in paragraphs 2 and 3 above shall take effect from 26 January 2004.
