Declaration under Article 42(1) Convention of International Rail Carriage 1999
Declaration on behalf of the United Kingdom of Great Britain and Northern Ireland under Article 42(1) of the Convention Concerning International Carriage by Rail (COTIF) of 9th May 1980 (in the version of the Protocol of Modification of 3rd June 1999).
To: - the International Organisation for International Carriage by Rail, ("OTIF").
Whereas:-
(a) The Protocol ("the Protocol") for the modification of the "Convention Concerning International Carriage by Rail of 9th May 1980" was signed at Vilnius on 3rd June 1999 and the United Kingdom was a signatory to it.
(b) The Protocol shall enter into force on the 1st July 2006 for those Member States which have ratified it before that date.
(c) The United Kingdom has decided to ratify the Protocol subject to the terms of this Declaration.
(d) This Declaration is deposited with OTIF, as Provisional Depositary within the meaning of Article 2 of the Protocol, at the same time as the United Kingdom's instrument of ratification.
It is declared as follows:-
1. In this declaration "the Convention" means the version of the "Convention Concerning International Carriage by Rail of 9th May 1980" as set out after article 7 of the Protocol and forming an integral part of the Protocol.
2. The United Kingdom of Great Britain and Northern Ireland declares, pursuant to article 42 of the Convention, that it will not apply the following Appendices to the Convention:-
(i) Appendix E - "CUI" - Uniform Rules concerning the Contract of Use of Infrastructure in International Rail Traffic.
(ii) Appendix F including its Annexes - "APTU" - Uniform Rules concerning the Validation of Technical Standards and the Adoption of Uniform Technical Prescriptions applicable to Railway Material intended to be used in International Traffic.
(iii) Appendix G - "ATMF" - Uniform Rules concerning the Technical Admission of Railway Material used in International Traffic.
3. In accordance with article 42(2) of the Convention, this declaration shall take effect at the moment the Convention enters into force in the United Kingdom.
