Gatwick legal challenge: government response

  • Medway Council, Kent County Council, Essex County Council and Messrs Mead and Fossett were challenging the Government's decision in last Julys airports consultation to exclude options for new runways at Gatwick from next years Air Transport White Paper.
  • They challenged the decision on a number of grounds and the case was heard in the High Court between 13 and 15 November.
  • On 26 November Mr Justice Maurice Kay rejected most of those grounds of challenge. However, he found that the decision to exclude Gatwick options was unlawful on three grounds and so decided that it should be quashed. The Government was granted leave to appeal against the decision.
  • The Secretary of State for Transport made a written statement to Parliament on 27 November.
